Judicial Reviews and the Aarhus Convention: Ensuring Access to Justice in Environmental Matters

In this fourth blog post, we will delve deeper into the role of judicial reviews in ensuring access to justice in environmental matters.
Judicial Reviews: A Critical Tool for Access to Justice
Judicial reviews play a crucial role in upholding the principles of the Aarhus Convention, particularly access to justice in environmental matters. These legal proceedings enable individuals and communities to challenge the legality of decisions, actions, or inactions by public authorities that impact the environment. By allowing for judicial scrutiny of public authorities, judicial reviews ensure that environmental laws are properly enforced and that citizens’ rights under the Aarhus Convention are protected.
Challenges in Accessing Judicial Reviews in the UK
Despite the importance of judicial reviews in ensuring access to justice, several challenges persist in the UK context. Some of these challenges include:
Financial barriers: The cost of bringing a judicial review claim can be prohibitive for many individuals and communities, particularly if the claim is unsuccessful and they are liable for the other party’s legal costs. Although cost-capping measures exist to protect claimants from excessive costs, these measures are not always sufficient to ensure that access to justice is affordable for all.
Procedural complexities: Navigating the complex procedural rules surrounding judicial reviews can be difficult, particularly for those without legal expertise. This can deter potential claimants from seeking redress for environmental grievances
Timeliness: Judicial reviews must be filed promptly and, in any event, within three months of the decision, action, or inaction being challenged. For planning cases, the limit is six weeks- this tight timeframe can make it difficult for potential claimants to gather the necessary evidence and prepare their case.
Our Commitment to Access to Justice
We provide legal support and guidance to individuals and communities seeking to challenge public authorities’ decisions, actions, or inactions in relation to environmental issues. We also advocate for reforms that address the barriers to accessing judicial reviews, such as reducing financial obstacles and simplifying procedural rules.
Case Study
In demonstrating these challenges, we present a 2009 report focusing on the substantial financial barriers faced by individuals, NGOs, and citizen groups when pursuing environmental litigation in the UK, using the Environmental Law Foundation (ELF) as an example. An analysis of our casework spanning over four years shows that the costs associated with judicial reviews often discourage potential litigants. Many cases, despite receiving favorable legal opinions recommending proceeding to judicial review, are abandoned due to these prohibitive costs. Protective Cost Orders (PCOs), which could limit a claimant’s liability for costs in public interest cases, are often difficult to obtain, mainly when the issues raised are not considered to be of general importance or in the public interest.
Recognizing the critical role of affordability and access in environmental justice, we are set to release an up-to-date report on these issues. The report will be discussed at a webinar on the 28th of June, providing deeper insights into the financial hurdles in environmental litigation and potential ways forward.
